This
STALLION BREEDING CONTRACT for the breeding season of 2008, made and entered
into on this ______ day of ________, 2008, is by and between Michelle Hagen of
North Pine Farm, hereinafter designated Stallion Owner; and
_________________________, hereinafter designated Mare Owner.
Mare Owner agrees to breed the Mare as described and listed below, and is
owned by or leased to the Mare Owner for the 2008 season, via Transported Cooled
Semen (TCS) to the American Paint Horse Stallion DOC FRECKLES APHA# 165,150
subject to the following conditions:
1.

2.
A copy of
both sides of the Mare’s Registration Papers must be furnished
3.
A
non-refundable Stud Fee of $500.00 is to be submitted with this signed and dated
contract when returned.
4.
The
breeding fee of $500.00 plus ALL expenses will be payable BEFORE the semen is
collected.
5.
There
shall be a Stallion Transportation fee of $50.00 each time is taken in for
collection, excluding initial shippment, in addition to collection/shipping
fees, payable to Stallion Owner.
6.
Requests
for semen shall be made by noon (12:00 pm) the day prior to required shipment.
All collection and shipping expenses are that of the Mare Owner.
No collection or shipping will be conducted on Sunday.
Collection and shipment will be performed by the Midwest Stallion
Station, 2550 Hindman Rd, Marion, IA 52302;
319-377-4091; fax 319-373-1588. A
credit card number or a check is required prior to collection.
Mare Owner may opt to pay Stallion Owner $250.00 to cover collection and
shipment fees in lue of paying MSS directly (for overnight delivery, an
additional $25.00 will apply to same day air freight delivery).
Shipping container must be returned to the MSS within 3 day – NO
EXCEPTIONS!
7.
Breeding season in force for this contract shall begin February 15th and
close June 15th , 2007.
8.
If mare
fails to settle, for any reason, Mare Owner will hold Stallion Owner blameless.
All mares are guaranteed to settle and carry to term.
If said mare does not settle first season, does not carry to term, or
foal born does not stand and nurse (live 24 hours), Mare Owner is entitled to
one season re-breed at no additional stud fee (normal transportation,
collection, and shipping fees apply). If
said mare does not settle on second year, no refund of stud fee will be given.
If mare proves unfit for breeding after 1st year, Mare Owner
may substitute a mare for the 2nd season, but not after 2 seasons
attempts have been made. A 3rd
year will be attempted via live cover only.
9.
In order to enact the Limited Color Guarantee; an additional fee of
$100.00 must be paid no later than July
1st
of breeding year. If said mare does
not produce a foal with qualifying color in any color breed association that the
foal is eligible for (APHA; PHBA, IBHA, ABHA, PtHA, etc.), mare owner will have
the option to rebreed said mare to said stallion for a stud fee of $100.00 the
following year. This fee is good
only the immediate season following the birth of a non-colored foal.
Cannot be transferred to a substitute mare or carried to the next
breeding season. No color
guarantees apply to this breeding. No discounts may be applied toward this stud fee; normal mare
care applies.
10.
Stallion
owner agrees to have all Association permits and paperwork in place prior to
first shipment of semen, and to send all appropriate paperwork with shipment.
11.
Stallion Owner will file all required documentation with the APHA.
For foals that may be registered in other associations, mare owner must
supply necessary forms; Stallion Owner will complete and submit.
A Breeder’s Certificate will be issued upon the notification of the
birth of a live foal providing all fees have been paid in full.
12.
Any owner presenting more than one mare per season shall receive a $25.00
discount on all mares. There shall
be a $25.00 discount next season to any returning mare, with a maximum discount
of $50.00 per mare (both may apply).
Discount is not applicable on $100.00 non-color rebreed.
13.
It is further understood that should the above named stallion die, or
become unfit for service, this contract becomes null and void, and the breeding
fee will be returned.
14.
This contract is non-assignable & non-transferable. It is entered into in the State of Iowa, and will be
interpreted and enforced under the laws of Iowa.
If any clause in this contract is against Iowa law, then that clause
shall be null and void. No other
agreements, promises, verbal or implied, are included unless specifically stated
in this written contract. The
original contract will be kept on file at North Pine Farm and a copy will be
provided to the Mare Owner.
15.
No Modification of this agreement shall be binding unless in writing and
executed by the parties hereto.
